In the Matter of Joseph R., Alleged to be a Person in Need ofSupervision, Appellant.

[*1]John A. Pappalardo, White Plains, N.Y., for appellant.

Charlene M. Indelicato, County Attorney, White Plains, N.Y. (Stacey Dolgin-Kmetz andMartin G. Gleeson of counsel), for respondent.

In a proceeding pursuant to Family Court Act article 7, Joseph R. appeals, as limited by hisbrief, from so much of an order of disposition of the Family Court, Westchester County (Devlin,J.), dated January 17, 2007, as, upon a fact-finding order of the same court dated October 5,2006, made upon his admission, adjudicating him a person in need of supervision, placed him inthe custody of the Commissioner of Social Services of the County of Westchester for a period of12 months for placement in a residential treatment facility.

Ordered that the appeal is dismissed as academic, without costs or disbursements.

The only issue raised by the appellant concerns that portion of the order of disposition whichplaced him in the custody of the Commissioner of Social Services of the County of Westchesterfor a period of 12 months for placement in a residential treatment facility. Since the placementperiod has expired, the appeal must be dismissed as academic (see Matter of Nicholas R., 36 AD3d923 [2007]; Matter of Ricky A.,11 AD3d 532 [2004]; Matter ofMary Veronica R., 10 AD3d 400 [2004]; Matter of Jeffrey McG., 8 AD3d 571 [2004]; Matter of BrandonS., 305 AD2d 609, 610 [2003]).
