As corrected through Wednesday, February 11, 2009

The People of the State of New York, Respondent,
v
KevinSceravino, Appellant.

[*1]Salvatore C. Adamo, Patchogue, N.Y., for appellant.

Thomas J. Spota, District Attorney, Riverhead, N.Y. (Edward A. Bannan of counsel), forrespondent.

Appeal by the defendant from an order of the County Court, Suffolk County (J. Doyle, J.), datedMarch 12, 2007, which, upon his consent, designated him a level two sex offender pursuant toCorrection Law article 6-C.

Ordered that the order is affirmed, without costs or disbursements.

Contrary to the defendant's contention, the record contains nothing to warrant the conclusion thathe was deprived of his constitutional right to the effective assistance of counsel, which resulted in hisconsenting to a level two sex offender designation (see generally People v Carey, 47 AD3d 1079 [2008]; see also People v Costas, 46 AD3d475 [2007]). Mastro, J.P., Rivera, Fisher and Eng, JJ., concur.
