Landlord appeals from an order of the Civil Court of the City of New York, New York County (Jaya K. Madhavan, J.), dated April 17, 2009, which granted tenant's motion for summary judgment dismissing the petition seeking a possessory judgment in a nonpayment summary proceeding without prejudice to a plenary action by landlord for damages.


Per Curiam.
