DECISION & ORDER ON MOTION

Motion by the appellant, in effect, to amend a decision and order of this Court dated June 29, 2010, which determined an appeal from an order of the Court of Claims, dated September 21, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, and the decision and order of this Court dated June 29, 2010 in the above-entitled matter (74 AD3d 1260) is amended by deleting from the fifth paragraph thereof the word "slipped" and substituting therefor the word "tripped."
