And defendant-appellant having moved for a anenlargement of time to perfect said appeal (M-5212),

And the People having moved to dismiss the aforesaidappeal for failure to timely prosecute (M-5630),

Now, upon reading and filing the papers with respect tothe motions, and due deliberation having been had thereon,

It is ordered that the motion for an enlargement of timeto perfect the appeal is denied (M-5212). The appeal isdismissed for failure to timely prosecute (M-5630).
