Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court,Kings County (Joseph E. Gubbay, J.), imposed October 13, 2015, upon his plea of guilty, on theground that the sentence was excessive.

Ordered that the sentence is affirmed.

The defendant's purported waiver of his right to appeal was invalid because, among otherthings, the Supreme Court's oral colloquy improperly conflated the right to appeal with the rightsautomatically forfeited by a plea of guilty (see People v Mack, 142 AD3d 1185 [2016]; People v Flores, 139 AD3d 753,753 [2016]). Nevertheless, the sentence imposed was not excessive (see People v Suitte,90 AD2d 80 [1982]). Scheinkman, P.J., Austin, Miller, Hinds-Radix and Maltese, JJ.,concur.
